Former Federal Bureau of Investigation Employee Alleges Improper Firing Because of Pride Banner Display

A veteran Federal Bureau of Investigation operative has initiated a legal case alleging he was let go on account of exhibiting a rainbow symbol within his office space.

According to David Maltinsky, that worked for the FBI over a decade and a half, his firing earlier this year was “unconstitutional and politically motivated”.

Legal Proceedings Asserts Free Speech Violations

The lawsuit argues that the agency violated the employee’s constitutional protections and initiated punitive action toward him due to engaging in protected expression.

The plaintiff is seeking a judicial directive to return his position within the agency.

Particulars from the Legal Filing

The comprehensive complaint, lodged in a Washington court in Washington, D.C., claims that Maltinsky was dismissed from his training in October for earlier showing the Pride symbol on his desk.

Per the filing, the Pride flag was awarded to the employee to honor his contributions to advance the FBI’s equality efforts.

Since childhood, all I have wanted to do has been to serve the nation and ensure public safety beside the skilled and devoted men and women at the agency,” stated Maltinsky.

He added, I exhibited that Pride flag – that previously flew in front of a federal building – not as a political statement, but as a representation of acceptance, solidarity and impartial service.

“These are the values that helped build the bureau effective. Now it is a place where employees like me are targeted. I believe I was terminated not on account of my identity, but due to my being: an openly gay individual,” he concluded.

Sudden Termination Just ahead of Graduation

Earlier this year, the plaintiff was accepted into the bureau’s agent training academy at Quantico, Virginia, before what he described as “sudden termination just three weeks before graduation”.

The filing further alleges that eventually following the presidential inauguration, a co-worker expressed a complaint to Maltinsky’s direct supervisor concerning the display of the rainbow banner.

To be safe, the plaintiff asked that the legal advisor for the Los Angeles field office review whether the display of the symbol was permissible,” the document said.

It further mentioned, The legal officer informed Maltinsky that the display of the flag was not against any policy, rule, or regulation.”

Notification of Dismissal

Despite this, on 1 October, the employee was informed of his firing.

In a letter cited in the lawsuit, bureau chief the director stated, “I have determined that you demonstrated poor judgment by exhibiting of a partisan emblem at your workstation while previously assigned at the L.A. bureau.

In accordance with Article II of the U.S. Constitution, and statutes of the nation, your job with the Federal Bureau of Investigation is hereby terminated.”

Lawyer Remarks

In a release released recently, his attorney the attorney remarked, The current leadership’s unlawfully firing him is a component of an extensive initiative to rid federal agencies of employees that possess divergent opinions, or are from minority populations, or who dare speak out against prejudice.

This battle is not just about him, but involves protecting the liberties and protections of all federal employees.”

Bureau Response

The FBI declined to comment regarding the case.

This legal action is subsequent to a separate case filed in September by ex- senior FBI officials who said they had been unlawfully fired.

They alleged that the official said he had been ordered by the White House to terminate any agent involved in an investigation into Trump.

Meanwhile, the agency fired a nearly three-decade veteran in November subsequent to the director was said to be angered over news that the agency head used an official aircraft to go to a wrestling event at which his companion rendered the Star-Spangled Banner.

The official, a bureau veteran for over two decades, was dismissed as head of the agency’s response team, responsible for major security threats and the bureau’s aircraft.
